Here’s What You Actually Need to Know Before 1 August 2025

Selling a home in Queensland? Heads up — the rules are changing, and you’ll need to be a bit more prepared than usual (don’t stress, we’ve got you).

From 1 August 2025, all sellers will need to hand buyers a fancy new doc called the Form 2 Seller Disclosure Statement before contracts are signed. And yes, it’s now legally required. No dodging it.

So… what is it?

It’s basically a “Here’s everything you need to know about this property” cheat sheet. It includes:

  • A title search (who owns it + any easements or encumbrances)

  • Zoning, notices, or anything council-related

  • Tenancy details if it's rented

  • Body corporate records (if it's a unit/townhouse)

  • And other stuff buyers should know upfront

If you’re thinking, “Shouldn’t that already be the case?” — yeah, but up until now, Queensland’s been a bit loose on that front.

Why this matters

If you don’t give this form, or it’s missing key info, the buyer can pull out of the deal before settlement — and yes, keep their deposit. Ouch.

Also: you can’t contract out of it. Any sneaky clause saying “buyer waives disclosure” = totally void. The law says so.

So really, this new rule’s about getting everything above board from the get-go — which we’re actually all for. More clarity = fewer surprises = smoother sales.

What sellers need to do

If you’re planning to sell from August onward:

  • Start prepping early. Don’t wait until a buyer’s knocking — talk to your agent (hey, us) and we’ll guide you through getting your documents sorted.

  • Expect a little more paperwork. Nothing scary — we’ll help you track down what’s needed.

  • Get ahead. The smoother you present your home (legally and visually), the faster the offers come.
